Referral Process

Referral to the program can be completed in two ways:

1) Pre-Citation (Law Enforcement Referral): Underage Drinking Court Application/Notice to the Defendant must be completed and delivered to Judge Lovecchio's chambers within 14 days from date when the notice was received. The arresting officer must sign the referral form, or document on the citation "recommended to the Underage Drinking Court."

2) Post-Citation (Judge/District Magistrate/Attorney/Other Governmental Official Referral): Underage Drinking Court Application/Notice to the Defendant must be completed and delivered to Judge Lovecchio's chambers within 14 days from the date when the notice was received. The arresting officer must sign the referral form, or document on the citation "recommended to the Underage Drinking Court."

Then, the defendant must contact the Court Coordinator (Chris Deal) at the West Branch Drug & Alohol Abuse Commission and schedule a Drug & Alcohol Assessment. Assessments should be scheduled within a 10 day period from the date of delivery of the Notice to the Defendant to the Judge's chambers.

Next, the Underage Drinking Court Team conducts a review of the Underage Drinking Court Application/Notice to the Defendant. Acceptance or denial of participation is determined by the team.

Finally, the letter of acceptance or denial is sent from Judge Lovecchio's chambers. In cases of acceptance, the defendant is then notified of the date of the first scheduled court session.
